தாமரை சின்னத்துடன் பேட்டியளித்த மோடி மீது நடவடிக்கை- தேர்தல் ஆணையம் உத்தரவு

7வது கட்ட லோக்சபா தேர்தல் இன்று நாடு முழுவதும் 89 தொகுதிகளில் நடைபெறுகிறது. இதில் குஜராத்தின் 26 தொகுதிகளும் அடங்கும். குஜராத்தின் காந்திநகரில் பாஜக மூத்த தலைவர் எல்.கே.அத்வானி போட்டியிடுகிறார். அங்கு தனது தாயாருடன் சென்று நரேந்திர மோடி இன்று காலை வாக்களித்தார்.

அதன் பின்னர் வாக்குச் சாவடிக்கு வெளியே தாமரை சின்னத்தை கையில் ஏந்தியவாறு செய்தியாளர்களுக்குப் பேட்டியளித்தார். இதற்கு காங்கிரஸ் மற்றும் ஆம் ஆத்மி கட்சிகள் கடும் எதிர்ப்பு தெரிவித்தது. வாக்குப் பதிவு நேரத்தின் போது தாமரை சின்னத்தை மோடி பயன்படுத்தியபடி பேட்டியளித்தது தேர்தல் நடத்தை விதிமீறலாகும். வாக்குச் சாவடி அருகே தாமரை சின்னத்துக்கு வாக்கு சேகரித்தது விதிமீறலாகும். இந்த சின்னத்துக்கு வாக்களிக்க வேண்டும் என்பதைத் தூண்டுவதாகும் என்று கண்டனம் தெரிவித்தது காங்கிரஸ்.

மேலும் இது தொடர்பாக தேர்தல் ஆணையத்திடமும் இன்று காங்கிரஸ் கட்சி புகார் மனு கொடுத்தது. அத்துடன் தேர்தல் நடத்தை விதிகளை மீறிய மோடி மீது வழக்குப் பதிவு செய்ய வேண்டும் என்றும் காங்கிரஸ் வலியுறுத்தியது.

இதனைத் தொடர்ந்து தேர்தல் ஆணையம் தீவிர விசாரணை மேற்கொண்டது, இந்த சம்பவம் குறித்து அகமதாபாத் மாவட்ட ஆட்சியரிடம் தேர்தல் ஆணையம் விளக்கம் கேட்டிருந்தது. இதனைத் தொடர்ந்து தேர்தல் விதிமுறைகளை மீறிய நரேந்திர மோடி மீது உரிய நடவடிக்கை எடுக்குமாறு குஜராத் மாநில தலைமை செயலர் மற்றும் டி.ஜி.பி.க்கு தேர்தல் ஆணையம் அதிரடியாக உத்தரவு பிறப்பித்துள்ளது.

Subject: Violation of provisions of Section 126 of R.p. Act 1951 by Sh. Narendra Modi & Others – regarding.

Sir,

1. The Commission has seen the video recording of the address by Sh. Narendra Modi at a meeting in Ahmedabad after he cast his vote today (30.04.14) in the morning. From the substance, tone and tenor of the address made by Sh. Modi and the statements made by him and the manner in which the symbol of Lotus of the BJP was being displayed by him at the said meet, thereby displaying to the public election matter by means of television in polling areas going to polls today it is evident that the said address was in the nature of political speech intended and calculated to influence and affect the result of elections in the constituencies going to polls today, not only in Ahmadabad but also in all other constituencies in the State of Gujarat and elsewhere in the country.

2. The Commission is of the view that by holding that meeting and also by addressing the same today when the polling is going on in the entire State of Gujarat and in different parts of the country, Sh. Narendra Modi has violated the provisions of Sections 126 (1) (a) and 126 (l) (b) of R.P. Act 1951. Therefore, the Commission directs under Article 324 of the Constitution and all other legal provisions enabling it in this behalf that complaints/ FIR as the case may be, should be filed against Sh. Narendra Modi and all others who were involved in the convening and holding of the said meeting, under the provisions of Sections 126 (l) (a) and 126 (1)(b). Further, if any restrictions have been imposed by the competent authority in Ahmadabad under Section 144 of CrPC, then complaints/FIR should also be made under Section 1gg of Ipc.-2-

3. The Commission further directs that all the TV channels and other electronic media which carried the proceedings/images of the said meeting and display of election matter (as defined in section 126(3) of R.P. Act, 1951) on their channels should also be proceeded against under Section 126 (l) (b) bV filing separate complaints/FlRs against those channels.

4. Compliance reports in this regard should be sent to the Commission latest by 6:00 PM today. Copies of complaints/FlRs should also be furnished to the Commission along with the compliance report.
